Section 1 – Scope

(1) These Terms of Service (hereinafter "Terms") apply to all orders placed through the online store at igetitproject.com (hereinafter "Online Store"). The Online Store is operated by Lukas Hahn, IGI Merch, Paulstraße 36, 10557 Berlin, Germany (hereinafter "we", "us" or "Seller").

(2) Our Online Store is directed at consumers worldwide. A "consumer" is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession. A "business customer" is any natural or legal person who acts in the exercise of their trade, business or professional activity when entering into the transaction.

(3) We do not accept any deviating terms of the customer unless we have expressly agreed to them in writing.

(4) For consumers habitually resident within the European Union: These Terms do not affect the mandatory statutory consumer protection rights to which you are entitled under the law of your country of habitual residence. Where any provision of these Terms conflicts with mandatory consumer protection provisions of your country of habitual residence, the provisions more favorable to you shall prevail.

(2) The presentation of products in our Online Store does not constitute a legally binding offer, but rather an invitation to place an order (invitatio ad offerendum). Product descriptions in our Online Store do not constitute a guarantee or assurance of specific properties.

(3) You may add products to your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided in the checkout process. By clicking the order button, you submit a binding offer to purchase the products contained in your shopping cart.

(4) Immediately after submitting your order, you will receive an automatic order confirmation by email. This order confirmation does not constitute acceptance of your offer; it merely confirms that your order has been received.

(5) The contract is formed when we accept your order by sending a separate order confirmation email or when we ship the goods to you. We reserve the right to decline orders for any reason, including but not limited to suspected fraud, unverifiable order or payment information, or delivery to regions we are unable to serve.

(6) By placing an order, you confirm that you have reached the legal age of majority in your country and that the information you have provided is correct and complete.

Section 3 – Contract Language and Storage

(1) The languages available for the conclusion of the contract are English and German.

(2) We store the contract text and send you the order details and our Terms in text form (e.g., by email). For security reasons, the full contract text is no longer accessible via the internet after the conclusion of the contract. You may, however, access these Terms at any time on our website.

Section 4 – Prices and Shipping Costs

(1) All prices displayed in our Online Store are final prices inclusive of applicable statutory value-added tax (VAT). The prices displayed at the time of your order are binding.

(2) In addition to the listed product prices, shipping costs apply and vary depending on the delivery address and shipping method. The exact shipping costs will be displayed in your shopping cart and during the checkout process before you complete your order. We offer free shipping to selected delivery regions above certain order values. Details can be found in our Shipping Policy.

(3) Prices are displayed in the currency designated for your region based on your location. The final price including shipping costs will be shown to you in the applicable currency at checkout before you complete your order.

(4) For deliveries to countries outside the European Union, additional customs duties, import taxes and fees may apply. These charges are the responsibility of the customer and are levied by the customs authorities of the destination country. They are not included in our prices. We recommend checking with your local customs office before placing your order to find out about any charges that may apply.

(5) We reserve the right to change prices, discounts and promotions at any time without prior notice. Orders that have already been confirmed are not affected by price changes.

Section 5 – Payment Methods

(1) Payment of the purchase price is due immediately upon placing the order. Your payment method will be charged when the order is submitted.

(2) The following payment methods are generally available in our Online Store (actual availability may vary depending on your location, currency and device):

Credit Cards: Visa, Mastercard, American Express, Maestro, UnionPay. You enter your credit card details during the checkout process. Your card is charged immediately upon submission of the order.

Shop Pay: Shop Pay is an accelerated checkout service provided by Shopify. Your payment and shipping information is stored for faster checkout. Payment is processed immediately upon order submission.

Apple Pay / Google Pay: If your device supports Apple Pay or Google Pay, you can use these digital wallets as a payment method. Your account is charged immediately upon order submission.

Klarna: Through the payment service provider Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, various payment options may be available to you depending on availability (e.g., instant bank transfer, pay later, installments). Klarna's terms of use apply. Further information and the exact conditions are provided during the checkout process and at www.klarna.com.

Bancontact (Belgium): Customers in Belgium can pay via Bancontact. The charge is processed immediately.

EPS (Austria): Customers in Austria can pay via EPS (Electronic Payment Standard). The charge is processed immediately through your bank.

PayPal: To pay via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, log in with your credentials and confirm the payment instruction. The payment transaction is processed by PayPal immediately upon order submission. Further details are provided during the checkout process.

USDC (Cryptocurrency): We accept payments in the cryptocurrency USDC. Conversion and settlement are handled by the respective payment service provider.

(3) We reserve the right to exclude or restrict certain payment methods at our sole discretion.

Section 6 – Products and Print-on-Demand

(1) All products offered in our Online Store are manufactured using the print-on-demand method. This means that each item is individually produced for you only after your order has been placed.

(2) Since our products are individually produced after ordering, we kindly ask you to take particular care when selecting your order details, especially size and design. Detailed product descriptions, available sizes and material properties are provided on each product page.

(3) We have made every effort to display the colors and appearance of our products in the Online Store as accurately as possible. However, please note that minor variations in color and appearance may occur due to different screen settings and printing processes. Such minor deviations do not constitute a defect.

(4) Please allow a standard production time of 1–3 business days after your order is received before your order is shipped.

Section 7 – Shipping and Delivery

(1) We ship products to the delivery address provided during the checkout process. We deliver by mail order only. In-store pickup is not available.

(2) Our Online Store ships worldwide. Estimated delivery times and shipping costs for each destination country are displayed in our Shipping Policy and during the checkout process. All stated delivery times are non-binding estimates and are not guaranteed delivery dates.

(3) If we are unable to fulfill an order in whole or in part, we will notify you without delay and promptly refund any payments already made.

(4) Transfer of risk for consumers: For consumers, the risk of accidental loss or deterioration of the goods passes to you upon delivery of the goods to you. In the case of mail-order purchases, the risk does not pass to the consumer until the goods are handed over to the consumer.

(5) Transfer of risk for business customers: For business customers, the risk of accidental loss or deterioration of the goods passes upon handover of the goods to the carrier, freight forwarder, or other person or entity designated to carry out the shipment.

(6) We are not liable for delays caused by the shipping carrier, customs processing, or force majeure.

Section 8 – Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

Section 9 – Right of Withdrawal and Returns

(1) For consumers with a delivery address in the European Union: You have a statutory right of withdrawal. You have the right to withdraw from your purchase within 14 days of receiving your order, for any reason and without justification. The full withdrawal instructions including the model withdrawal form can be found on a separate page in our Online Store under Return & Refund Policy.

(2) For consumers with a delivery address in the United Kingdom: Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods, for any reason and without justification. The same conditions, timeframes and procedures as described for EU customers apply accordingly.

(3) For customers with a delivery address outside the EU and the United Kingdom (including the USA, Canada, Australia and all other countries): As our products are individually manufactured using the print-on-demand method after each order is placed, we are unable to accept returns for change of mind, wrong size selection, or buyer's remorse. Returns and refunds are provided if the goods arrive damaged, defective, or incorrectly delivered.

(4) For customers in Australia: Notwithstanding the above, under Australian Consumer Law, you are entitled to a replacement or refund if a product has a major fault, is not of acceptable quality, or does not match the description on our website.

(5) Damaged or defective goods (worldwide): If your order arrives damaged, defective, or materially different from the description on our website, we will offer you a free replacement or a full refund regardless of your location. Please contact us within 14 days of delivery at info@igetitproject.com with your order number, a clear photo of the damage or defect, and a brief description of the issue.

(6) For further details on returns, refund timelines and the process, please refer to our Return & Refund Policy.

Section 10 – Warranty

(1) Statutory warranty law applies. For consumers, the warranty period is two years from delivery of the goods.

(2) Please note that minor variations in color and brightness between the product as displayed in the Online Store and the actual product may occur due to printing processes and do not constitute a defect.

(3) Information about any additional guarantees and their specific conditions can be found on the respective product page and on special information pages in the Online Store.

Section 11 – Limitation of Liability

(1) We are liable without limitation for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty on our part, as well as for damages covered by the German Product Liability Act (Produkthaftungsgesetz).

(2) We are liable without limitation for damages caused by intentional or grossly negligent breaches of duty on our part.

(3) In the case of a breach of material contractual obligations (cardinal obligations) — obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely — our liability for slight negligence is limited to the foreseeable, contract-typical damage.

(4) In all other cases, our liability for slight negligence is excluded.

(5) The above limitations of liability also apply in favor of our legal representatives, vicarious agents and employees.

(6) For consumers in the European Union, mandatory statutory liability provisions remain unaffected by the above limitations. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Section 12 – Intellectual Property

(1) All content of our Online Store, including text, graphics, images, product designs, logos and the overall design of the store, is protected by copyright and is the property of IGI Merch or our licensors.

(2) The reproduction, distribution, modification or any other use of the content beyond the scope of copyright law requires our prior written consent. Downloads and copies are permitted for personal, non-commercial use only.

(3) Products purchased through our Online Store may be freely used, including for resale. However, the intellectual property rights in the designs and motifs remain with IGI Merch; reproduction or imitation of the designs themselves is not permitted.

Section 13 – User Submissions and Feedback

(1) If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, ratings or other content through our Online Store (collectively, "User Submissions"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and publicly display such User Submissions in any form and in any medium. We may use these rights in particular for the operation, improvement and promotion of our services.

(2) You represent and warrant that: (a) you own or have all necessary rights to your User Submissions; (b) you have disclosed any compensation or incentives received in connection with your submission; (c) your User Submissions comply with these Terms.

(3) Your User Submissions must not: (a) infringe the rights of any third party, including copyright, trademark, privacy or other proprietary rights; (b) contain unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable content; (c) contain viruses, malware or other harmful code; (d) be submitted under a false identity or with misleading information about their origin.

(4) We are under no obligation to maintain User Submissions in confidence, to pay compensation for them, or to respond to them. We reserve the right to monitor, edit or remove User Submissions at our sole discretion, in particular if they violate these Terms or applicable law.

(5) You are solely responsible for your User Submissions and their accuracy. We assume no liability for User Submissions posted by you or any third party.

Section 14 – Privacy

Information about the processing of your personal data can be found in our Privacy Policy. By using our Online Store, you acknowledge that you have read the Privacy Policy. Our Online Store is operated on the Shopify platform; Shopify also processes personal data in this context. For more information, please refer to Shopify's Privacy Policy.

Section 15 – Prohibited Uses

You may access and use our Online Store and the services offered exclusively for lawful purposes. In particular, the following is prohibited: (a) using the store for unlawful or malicious purposes; (b) violating applicable laws or regulations; (c) infringing our intellectual property rights or those of third parties; (d) transmitting false or misleading information; (e) uploading viruses, malware or other harmful code; (f) reproducing, selling or otherwise exploiting the store or parts thereof without our consent; (g) using automated systems, bots, scrapers or similar tools to access the store; (h) collecting or tracking the personal information of other users; (i) circumventing or interfering with security features or access restrictions of the store. We reserve the right to suspend access to the store at any time without notice in the event of violations.

Section 16 – Automated Agents

(1) This section applies if you use, allow, enable, or cause the deployment of an "Agent" to access, use or interact with our services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed without direct supervision.

(2) No Agent may access our services unless it identifies itself as an Agent at all times and operates in strict accordance with the requirements in subsection (4) below.

(3) We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with our services.

(4) Agents must: (a) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (b) not conceal or obfuscate that any access, use or interactions are from an Agent, such as by mimicking human behavior and interaction patterns or by completing or circumventing CAPTCHAs; (c) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; (d) not circumvent or otherwise avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with our services.

Section 17 – Indemnification

(1) You agree to indemnify, defend and hold harmless IGI Merch, Shopify, and their respective affiliates, partners, officers, directors, employees, agents and service providers from any claims, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law or the rights of a third party; (c) your access to and use of our services.

(2) We will notify you of any indemnifiable claims. A delay in notification does not relieve you of your obligations unless you suffer material prejudice as a result.

(3) For consumers habitually resident in the European Union: This indemnification obligation applies only insofar as the claim is based on your culpable conduct. Mandatory statutory consumer protection provisions remain unaffected.

Section 18 – Governing Law and Jurisdiction

(1) These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) If you are a consumer habitually resident in a member state of the European Union, you shall additionally enjoy the protection of the mandatory provisions of the law of the state in which you are habitually resident. The choice of law in subsection (1) does not have the effect of depriving you of the protection afforded to you by mandatory provisions of the law of your country of habitual residence (Article 6(2) of the Rome I Regulation).

(3) If you are a consumer habitually resident in Germany, the courts at your place of domicile shall have jurisdiction. Otherwise, the statutory provisions on jurisdiction shall apply.

(4) If you are a business customer, the exclusive place of jurisdiction for all disputes arising out of or in connection with the contractual relationship shall be Berlin, Germany.

Section 19 – Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Section 20 – Severability

If any provision of these Terms is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by the applicable statutory provision.

Section 21 – Changes to These Terms

We reserve the right to amend these Terms at any time. The current version of these Terms is available on our website at all times. For contracts that have already been concluded, the version of the Terms in effect at the time the order was placed shall apply.
